I'd be happy if I got a second opinion (my lawyer's is the first) on this issue:
I am ready to file for my AOS(I-485) for the second time based on my employers I-140 petition and would like someone (unitednations ?) to see if there are any possible gotchas.
Chronology
========
#1 May 2001 - Come to US on H1B (California) I-94 valid till Nov 2003
#2 Oct 2001 - Change employers and get a H1 transfer (California) New I-94 valid till Feb 2004
#3 Nov 2002 - Fall in love with an American girl
#4 Dec 2002 - Quit job and move to Michigan to be with girlfriend (Out of status)
#5 March 2003 - Find job in MI, employers lawyer botches my H1 transfer / extension (Out of status)
#6 October 2003 - Fall out with employer and quit.
#7 November 2003 - Marry girlfriend (Out of status)
#8 April 2004 - Wife files I-130/I-485/I-765 (AOS Pending status)
#9 April 2004 - Find a new employer "X" and start working for him
#10 June 2004 - Wife and I have irreconcilable differences and I separate, later file for divorce
#11 June 2004 - "X" petitions for new H1B for me for FY-2005 starting in Oct.
#12 July 2004 - leave US and go back to homeland, get new H1 visa stamped with expiration date of June 2007
#13 Sept. 2004 - Come back to the US with new H1 visa stamp and get new I-94 (exp. June 2007) -----> Fresh start, eh ?

#15 Dec 2004 - "X" files Labor RIR EB3. PD is Dec 2004

#18 March 2006 - Voluntarily went to local CIS office and withdrew old I-485. Proof of withdrawal obtained.
#19 June 2006 - EB2 I-140 filed with copy of labor (Still pending) Obtained receipt
#20 Oct 2006 - EB3 labor approved from backlog center
#21 May 2007 - File for 7th year H1B extension
#22 Jun 2007 - EB3 I-140 filed (Still pending). Obtained receipt
#23 Jul 2007 - H1B Extension approved (new I-94 with expiration of Jun 2008)
#24 Jul 2007 - Ready to file I-485 concurrent with EB3 I-140
Since 2004 I have maintained valid non-immigrant status (I think). Will I have any issues with accrual of out of status / unlawful stay based on my actions above ?
As you can see, mine is not a straightforward case.
The million dollar question : Based on my actions in steps #4 thru #10, is there a chance that my new I-485 will be adversely affected ? If so, is there anything that anyone can tell me to remedy/rectify the situation to avoid it ?

The Receipt date is the date when they actually receive our case in a Service Center. Notice date is when it got entered into the system. I-485 Notice shows both the RD and ND. RD should be August 17 for most of us, whose cases were transferred to various Service Centers. Online status shows the ND. The only confusion here is what do they go by(may be USCIS it self not sure how to prioritize - whether on ND or RD).
Strictly speaking, if they go by ND and if the ND is after Aug-17 we may not be eligible for GC, as our(July/Aug 07 batch) cut-off dates is august-17-2007. This is what I was told by DAO when I attended the interview at the local USCIS office.

I applied for passport renewal (Chicago consulate) without name change form. In the Online application, I splitted the name as needed (earlier my name was under Given name). The renewal passport was sent to me with the way I entered the name (splitting) without any additional forms or affidavits.

If it is just a name change from maiden to married (i.e. change in surname) you don't need a court order. All you need is your marriage certificate and a notarized affidavit to change the name on the passport.

Not all nannies are bad. And next time, hire a nanny in a legal manner.

I remember the IO asking my spouse about being a member of a job-related professional association. My spouse used to be a member of such an organization and mentioned so. The IO then remarked that such membership is a requirement for such kind of a job. She then just let it go, however.

I saw there are 50 replied to this post. Looks like people are more interested in others problems than their own.
Its pity that MOST CRITICAL issue we are facing at present - AC21 Denial issue, is having only 77 mails but everyone is jumping gossipping. Come out of this and show a unity to real problems.
Grow up and don't escape from real problems. Its our problem and we need to fight to resolve it.

I am in with a contribution.What if USCIS sees us as a Golden Duck and want another 10k after eating initial 5k.You know how government projects work?What will we do next?I am not undermining anyones initiatives,I always wanted to know how many applications are actually pending?May be better than doing nothing.I think some one was saying that citizenship information is not entered in the system.Nobody knows how that CLAIMS system looks like.We can see perm data fields on flcdatacenter.com, may be we should request on line version for CLAIMS system.with SOA capabilities it could be easily mapped in to easily readable frontend with minimal efforts.People can actually file 485 on line? Its not at all complicated.Govt contractors will make it look like a $100Million project.

In my opinion by 'Using the unused EB2 visa for EB3 ROW instead of EB2 India', USCIS is following the law as congress pased it...The law may be not fair but that is a different issue...If you want to change the law you have to get that done from the congress...suing USCIS would get you nowhere....
People seem to think uscis/dos is doing it wrong and it should be going horizontal rather then vertical. However, since people just keep getting mad at it because they think dos is doing it wrong but are not willing to do something about it.
The main thing ac21 did differently then before enactment of ac21 was that it allowed unused visas from ROW to be used by other countries on a quarterly basis and not in the final quarter.
One of the frustrations is that dos/uscis was very lazy in approving cases and allowing 485 filings and weren't watching because they allowed too manyh people to file (as soon as there are more applicatoins then visa numbers they are supposed to establish cut off dates). They had more applications then what they can approve long before they actually established cut off dates (January 2005). However, people got spoiled. Now they are going back and being very careful about it. This situation should have presented itself much before it actually did.
